Terms of Service – SplashDigital
Effective Date: January 2026
These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “Customer”, “You”) and SplashDigital (“Company”, “Platform”, “We”, “Us”, “Our”) governing your access to and use of all services, systems, applications, websites, tools, and digital resources provided by SplashDigital.
By accessing, registering for, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any provision contained herein, you must immediately cease all use of the Platform and associated services.
1. Eligibility and Registration
1.1 You represent and warrant that all information provided during registration or at any time thereafter is accurate, truthful, current, and complete.
1.2 You agree to promptly update any information to ensure its continued accuracy.
1.3 The creation and maintenance of more than one account per individual or legal entity is strictly prohibited unless express written authorization has been granted by SplashDigital.
1.4 The Company reserves the right, at its sole discretion, to refuse service, registration, or access to any individual or entity for any reason permitted by applicable law.
2. Account Security and Responsibility
2.1 You are solely and exclusively responsible for maintaining the confidentiality and security of your account credentials, including but not limited to usernames, passwords, authentication tokens, and recovery information.
2.2 You agree not to disclose, share, transfer, or permit the use of your account by any third party.
2.3 Any activity conducted through your account shall be deemed to have been performed by you, whether or not authorized.
2.4 SplashDigital shall bear no liability for any loss, damage, or unauthorized access resulting from your failure to safeguard your account information.
2.5 You must notify SplashDigital immediately upon becoming aware of any suspected breach of security or unauthorized use.
3. Description of Services
3.1 SplashDigital provides digital, automated, subscription-based, wallet-enabled, and credit-based services delivered primarily through electronic systems.
3.2 The Platform may rely on automated processing, third-party integrations, artificial intelligence systems, and external infrastructure.
3.3 You acknowledge that service availability, functionality, features, user interfaces, and pricing structures may be modified, updated, limited, or discontinued at any time without prior notification.
3.4 The Company does not guarantee uninterrupted, error-free, or permanent availability of any service.
4. Payments and Financial Transactions
4.1 All payments are processed through independent third-party payment gateways.
4.2 SplashDigital does not collect or store sensitive financial credentials such as full card numbers or banking authentication data.
4.3 You are responsible for ensuring that payment information is valid and that sufficient funds are available.
4.4 Failed, disputed, reversed, or fraudulent transactions may result in immediate suspension or termination of services without liability to the Company.
4.5 Prices, fees, and billing structures may be revised at any time at the sole discretion of SplashDigital.
5. Wallet Balances, Subscriptions, and Credits
5.1 Any wallet balance, virtual credit, token, or similar unit issued by SplashDigital is valid exclusively within the Platform and holds no external monetary value.
5.2 Credits and balances may be subject to usage limits, expiration periods, or additional conditions as determined by the Company.
5.3 Unused credits or balances may expire without refund, replacement, or compensation.
5.4 Subscriptions, packages, and credit systems may be modified, paused, replaced, or discontinued at any time without prior notice.
5.5 The Company is under no obligation to provide refunds for unused services unless required by applicable law.
6. User Content and Intellectual Property
6.1 Users may voluntarily upload, submit, transmit, or store content including but not limited to text, images, files, links, and data (“User Content”).
6.2 You affirm and guarantee that you possess all necessary rights, licenses, and permissions to use and upload such content.
6.3 SplashDigital bears no responsibility for verifying ownership, legality, or compliance of User Content.
6.4 You agree to indemnify the Company against any claims arising from copyright infringement, defamation, or unlawful use of content submitted by you.
7. Prohibited Conduct
7.1 You expressly agree that you shall not:
- Utilize the Platform for any unlawful, fraudulent, or deceptive purpose;
- Interfere with, disrupt, or abuse automated systems or infrastructure;
- Attempt to reverse engineer, decompile, manipulate, or exploit any component of the services;
- Resell, redistribute, or commercially exploit services without authorization;
- Upload viruses, malware, harmful code, or disruptive material.
7.2 Any violation may result in immediate suspension, termination, or legal action.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, SplashDigital shall not be liable for:
- Actions or restrictions imposed by third-party platforms;
- Indirect, incidental, special, or consequential damages;
- Loss of data, revenue, profits, or business opportunities;
- Interruptions caused by technical failures, cyber incidents, or external factors.
8.2 All services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
9. Suspension and Termination
9.1 SplashDigital reserves the absolute right to suspend, restrict, or terminate any account without prior notice where:
- These Terms are breached;
- Fraudulent or abusive behavior is detected;
- Legal or regulatory concerns arise.
9.2 Termination may result in permanent loss of access, data, credits, and balances.
10. Governing Law and Jurisdiction
10.1 This Agreement shall be governed and interpreted in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
10.2 Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka.
